Description

A site instruction, a WhatsApp message, and a letter are not the same thing. Writing “works” in a letter is not the same as writing “Works”. One is ordinary English. The other is a defined term, and it can change the subject of the letter.

Construction projects lose time and money in that gap. Not because the engineer does not know the site, but because the wrong person instructed the work, the notice was late, or the record was never kept. Entitlement is often lost on the date, not on the facts.

This course is for the construction engineer who has just been moved into a contracts function, or who wants to move into one from site, design or planning. It is not a law degree, and it is not a clause-by-clause reading of a standard form. Across ten sessions the attendee learns one working habit: read the document that governs the event, operate the procedure the Contract requires, and leave a record that still makes sense twelve months later.

What you will learn?

By the end of the course the attendee will be able to:

  • Separate contract administration from project management, quantity surveying and legal advice.

  • Open a contract package and decide which document speaks when the drawings, the specification and the Particular Conditions do not agree.

  • Tell an instruction from a determination, and from advice that does not bind anyone.

  • Identify the Commencement Date, what the programme is for, and what protects an extension of time.

  • Follow a payment application from statement to certificate, and keep an uninstructed amount out of the certified sum.

  • Tell a variation from a claim, and value a variation by the route the contract already gives.

  • Draft a notice that meets the contract formalities and the time-bar, and state what a contemporary record is.

  • Explain what a Taking-Over Certificate moves: risk, insurance, delay damages and retention.

  • Allocate a typical site event to the party that carries it, and know when a bond or insurance certificate is still alive.

  • Know how to prepare for a claim, set the records, establish entitlement, and stand on solid contractual ground.

Requirements

Basic knowledge of

• A live or recent construction project. Site, technical-office or planning experience is an advantage.

• No prior contracts posting is assumed.

• A copy of the project conditions, if the attendee has one, is useful from Session 02. It is not required to enrol.
